1. Agreement

These terms are an agreement between you and Openoffice Technologies, Inc., a Delaware corporation doing business as BoothScan, with operations in Frisco, Denton County, Texas (“BoothScan”, “we”, “us”). By creating an account or using the service, you accept these terms. If you are accepting on behalf of a company, you confirm you have authority to do so.

2. The service

BoothScan lets conference teams capture leads by scanning QR codes and business cards, add notes and voice notes, record where a conversation happened, share leads across a team and multiple events, score lead quality, measure event return on investment, and export everything to a spreadsheet. We may add, change, or remove features over time.

3. Accounts

You are responsible for the accuracy of your account details, for keeping your login credentials secure, and for activity that happens under your account. Team leaders are responsible for the members they invite and for the access they grant.

4. Your data

You keep ownership of the leads, notes, and other content you add to BoothScan. You grant us the limited right to host, process, and display that content in order to operate the service for you and your team. We use it for no other purpose.

5. Acceptable use

You agree not to:

  • capture, store, or contact people in ways that break applicable privacy, marketing, or anti-spam laws, or that break the rules of the event you are attending;
  • upload unlawful content, malware, or content you have no right to use;
  • attempt to access other organizations’ data, probe or disrupt the service, or work around access controls;
  • resell or redistribute the service without our written agreement.

You are responsible for having a lawful basis to collect the contact details you capture and for honoring the requests of the people behind those records.

6. Scanning, transcription, and drafted messages

Card scanning, QR profile lookups, voice-note transcription, lead scoring, and drafted follow-up messages are automated and can be incomplete or wrong. Review the results before you rely on them or send anything to a contact. Return-on-investment figures are estimates based on the numbers you enter and are not financial advice or a forecast.

7. Third-party services

The service relies on third-party providers for hosting and for some processing features, and it may link to third-party sites and profiles. We are not responsible for third-party content or services.

8. Fees

Paid plans, if offered to you, are described at the time of purchase. Fees are stated exclusive of taxes unless noted, and you authorize us to charge the payment method you provide for the plan you select.

9. Our intellectual property

The BoothScan software, brand, and materials remain ours. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.

10. Availability

We work to keep BoothScan available, and offline capture is designed to keep working when a venue has no signal, but we do not promise uninterrupted or error-free operation. Keep your own exports of information that matters to you.

11. Disclaimers

Except where the law does not allow it, the service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amounts you paid us for the service in the twelve months before the claim, or US$100 if you paid nothing.

13. Suspension and termination

You may stop using the service and ask us to close your account at any time. We may suspend or end access if these terms are breached or if required by law. On termination, your right to use the service ends; export your leads before you close your account.

14. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The courts located in Denton County, Texas have exclusive jurisdiction over disputes, and each party consents to that venue.

15. Changes to these terms

We may update these terms as the product changes. We will revise the “last updated” date above, and continued use of the service after a change means you accept the updated terms.
